A federal judge ruled that the Justice Department unlawfully fired prosecutor Maurene Comey, daughter of former FBI Director James Comey, in July 2025. Judge Jesse Furman wrote the DOJ invented an expansive theory of executive power and violated her due process rights. The ruling orders back pay and offers her return to her post, but the DOJ says it will appeal and the order is not final. The judge has not yet ruled on her First Amendment claim.
